明代“淹禁”述论
On the Yanjin in the Ming Dynasty

「淹禁」とは、司法機関が案件を受理したのちに、犯人を長期間監禁して判決を下さない、あるいは判決が出たのに執行しないことをいう。本論文は、「淹禁」の背景を人的、制度的要因から探り、明朝が「淹禁」を解決するために行った取り組みについて論じている。
